Doveva eliminare la corruzione in Kossovo, missione Ue nella bufera per tangenti

Lanciata sei anni fa per aiutare i kossovari a combattere corruzione e illegalità, la missione "Eulex" è finita al centro della bufera mediatica per un caso di presunte tangenti che coinvolge alti funzionari di mezzo mondo

Non è ancora passata una settimana dall'insediamento di 
Federica Mogherini come Alto rappresentante per la politica estera della Ue che già il neo "ministro degli esteri" dell'Unione si trova per le mani una bella patata bollente, forse la peggiore degli ultimi decenni di tutta la politica estera europea.

Si tratta dello scandalo di corruzione che ha travolto Eulex, missione avviata nel 2008 per assistere il cammino verso la democrazia del neonato Kosovo. Maria Bamieh, il procuratore britannico che ha svelato i numerosissimi casi di tangenti ed episodi di corruzione di cui sono accusati i più alti gradi di Eulex, è stata sollevata dal suo incarico. Il pubblico ministero britannico punta il dito contro quelli che chiama "due anni di mobbing, ispezioni e controlli", dovuti, secondo lei, alle accuse che aveva mosso contro i massimi responsabili della missione europea.

Nel mirino delle accuse della Bamieh è finito tra gli altri il magistrato italiano Francesco Florit, accusato di aver preso tangenti in cambio dell'insabbiamento di alcune indagini. Florit però sostiene che queste ipotesi siano "senza fondamento" e, pur accusando la Bamieh di essere "molto abile a relazionarsi con i media nonostante sia sotto indagine amministrativa da due anni", si dice contento che la questione venga esaminata fino in fondo. Con lui, tra gli altri, sono stati accusati anche il procuratore ceco Jaroslava Novotna e il magistrato anglo-canadese Jonathan Ratel.

Nel frattempo, lo scorso 24 ottobre la Bamieh è stata rimossa dal suo incarico a Pristina, capitale del Kosovo, per "cattiva condotta": Eulex ha fatto sapere che è sospettata di aver diffuso documenti riservati. La donna ha negato ogni accusa e continua a sostenere di essersi rivolta alla stampa solo dopo che le erano state contestate le accuse.

"È una vergogna che un'organizzazione che dovrebbe rappresentare la legge non sia essa stessa sottoposta alla legge - attacca la Bamieh parlando a The Guardian - Che messaggio stiamo mandando al Kosovo? È come se dicessimo al popolo kossovaro che se qualcuno dell'organizzazione criminale parla, bisogna prenderlo a calci nei denti. Stiamo dando l'impressione di non essere persone serie per quanto riguarda la corruzione, che l'istituzione chiamata a garantire la legalità si comporta in realtà in modo vergognoso."

Nel frattempo il nuovo responsabile di Eulex, Gabriele Meucci, assicura di "prendere molto sul serio" le accuse della Bamieh, ed anche la Mogherini ha annunciato, da Bruxelles, che una commissione legale indipendente ed esterna sarà inviata in Kosovo per monitorare la situazione. Una misura accolta con favore dalla diretta interessata: "Ben venga un'indagine indipendente, non mi fido di quelle interne", chiosa la Bamieh.

Eulex, costata più di un miliardo di euro, in sei anni ha lasciato il Kosovo, da cui aveva promesso di estirpare la corruzione, in condizioni ancora peggiori di quelle in cui si trovava all'inizio della missione. Analisti locali interpellati da The Guardianricostruiscono come il livello di criminalità organizzata e corruzione nel sistema politico del Paese siano notevolmente peggiorati dal 2008 ad oggi.

Scandalo Eulex: le rivelazioni reticenti

La missione europea in Kosovo è sott'accusa. Andrea Lorenzo Capussela spiega perché, per giudicarne l'operato, non si deve però limitarsi ad indagare le rivelazioni rilasciate dall'ex pubblico ministero Eulex Maria Bamieh

Le gravi accuse che un ex pubblico ministero di Eulex, Maria Bamieh, ha recentemente mosso contro alcuni dei suoi colleghi e dei suoi superiori hanno riempito le pagine dei quotidiani kosovari, sono state discusse dal Parlamento europeo ed hanno portato l'UE a promuovere un'indagine indipendente. Proverò però a spiegare come quelle rivelazioni siano troppo selettive per essere d'aiuto ad analizzare quando fatto da Eulex e che quello di cui ora ci sarebbe bisogno è un'analisi approfondita ed estesa dell'operato di Eulex nell'esercitare le sue funzioni giudiziarie.

Considerate quest'esempio: A e B concordano una transazione con H e K; C l'approva; A e B danno istruzioni a X, Y e Z per compiere le necessarie azioni per implementarla. La transazione è però illegale e un pubblico ministero avvia delle indagini preliminari. Esistono prove documentali che descrivono l'accordo intercorso tra A-B e H-K, il consenso di C e le istruzioni consegnate a X-Y-Z e le azioni che questi ultimi hanno messo in pratica per implementare la transazione. Il pubblico ministero decide allora di avviare un'indagine formale. A carico di chi vi aspettereste fosse? E, ipotizzando che la transazione sia stata veramente illegale, chi, a vostro avviso, ha commesso i crimini più gravi?

Tenete a mente le vostre risposte e considerate anche il seguente: la transazione riguarda il trasferimento ad un'università privata di proprietà straniera – l'American University in Kosovo (AUK) - di un terreno di proprietà statale nei pressi della capitale del Kosovo, che era nel portfolio dell'agenzia di privatizzazione kosovara. Negli anni in cui l'accordo è stato concepito e in cui si è iniziato ad implementarlo, nel 2010-2011, A e B erano i ministri dell'Educazione e della Finanza del Kosovo: il primo è ora ministro degli Esteri e il secondo ambasciatore in Giappone. C era ed è ancora primo ministro del Kosovo. H e K erano il presidente dell'AUK e il vice-presidente dell'università privata: il primo un cittadino straniero, il secondo un kosovaro. Infine X,Y e Z sono (sei) direttori e funzionari dell'agenzia di privatizzazione e il consulente esterno assunto per valutare il terreno. Infine A-B e H-K hanno agito di concerto con D, che è morto nel 2012: D era il direttore e de facto boss indiscusso dell'agenzia di privatizzazione e il consulente economico informale di C, il primo ministro. X-Y-Z hanno agito sotto le istruzioni di D.

Il pubblico ministero incaricato del caso era Maria Bamieh, l'autrice delle recenti rivelazioni. La sua scelta è stata quella di puntare l'indagine solo su X, Y e Z. Lo so perché me lo ha detto lei.

Tra il 2008 e il 2011 ero infatti un membro del consiglio dei direttori dell'agenzia di privatizzazione e nel settembre 2010 ho ricevuto una serie di documenti ufficiali che descrivevano la transazione, i suoi dettagli, le sue origini e le persone coinvolte. Immediatamente dopo che il consiglio dei direttori ha approvato la transazione, nonostante le mie obiezioni, ho consegnato questi documenti ad Eulex, assieme ad un rapporto che sottolineava le ragioni per cui, a mio avviso, la transazione pareva illegale e rischiava di causare un significativo danno all'erario del Kosovo (potenzialmente 18 milioni di euro o lo 0.4% del Pil del 2010 o, in altri termini, 5000 volte il salario medio annuale in Kosovo; inoltre oltre all'erario i perdenti in quell'accordo furono i dipendenti dell'azienda privatizzata che era la proprietaria del terreno).

Quindici giorni dopo una lettera del procuratore capo Eulex per crimini gravi mi informava che la missione non avrebbe investigato sul caso, senza spiegare perché.

Poco dopo aver lasciato il Kosovo, nel giugno 2011, ho criticato in alcuni articoli pubblicati su Koha Ditore e su media internazionali (paywall) l'accordo AUK e l'inazione di Eulex ed ho nuovamente inviato i documenti in mio possesso ad Eulex, il cui capo procuratore per crimini gravi era nel frattempo cambiato.

Non ho ricevuto alcuna risposta dalla missione sino a quando, il 29 marzo 2014 Maria Bamieh – con la quale non avevo avuto alcun contatto sino ad allora – mi ha mandato una mail con la seguente richiesta:

“Ho preso in carico alcuni casi prima seguiti da altri pubblici ministeri [nella procura di Eulex per crimini gravi]. Vorrei parlarle e se necessario ricevere da lei una dichiarazione formale. Sto indagando su [seguono i nomi dei cinque casi]. Ho necessità di raccogliere prove il prima possibile perché il tempo sta scadendo”.

Tre dei casi riguardavano accordi di privatizzazione sui quali avevo molte informazioni, ma rispetto ai quali non avevo elementi seri per ritenere vi fossero delle malversazioni. Uno di questi è un caso – che coinvolge Azem Syla e la vendita di un altro terreno di proprietà statale – rispetto al quale la Bamieh ora afferma che le sue indagini sono state osteggiate dai suoi superiori. I restanti due dei cinque casi erano stati oggetto di relazioni che avevo consegnato a Eulex per stimolare indagini. Uno di questi è il caso AUK.

Ne è seguito uno scambio di e-mail e di telefonate. Maria Bamieh mi ha scritto che “tutto ciò di cui sono in possesso [relativamente al caso AUK] è ciò che lei ha inviato a [Eulex]”. Quindi le ho confermato il mio punto di vista su quei documenti e sulla transazione ed ho anche fornito una mia opinione sugli aspetti finanziari della questione. Lei poi mi ha chiesto di commentare la bozza della sentenza – un documento in otto pagine, che riassumeva prove e capi d'accusa – con la quale intendeva aprire un'indagine formale.

Che l'accordo AUK sia legale o illegale, è quindi documentato che Maria Bamieh ritenesse – almeno in quel momento – che nell'averlo ideato e condotto l'agenzia si era resa colpevole di alcuni crimini e che la Bamieh è arrivata a queste conclusioni esclusivamente sulla base dei documenti che io avevo fornito alla missione Eulex.

Quando ho espresso a Maria Bamieh le mie riserve sulla sua scelta di non indagare coloro che si erano accordati su quella transazione e che ne avevano beneficiato, mi ha risposto che aveva “bisogno di prove” contro di loro. Ma i documenti di cui era in possesso, al contrario, indicavano nel dettaglio i nomi, le decisioni prese e le azioni di ciascuno dei principali sospettati e la sequenza degli eventi suggeriva fortemente che anche loro – e non solo X-Y-Z – erano consapevoli che la transazione era illegale (radicalmente, a mio avviso). Le prove che aveva contro A-B-D-H-K, in altre parole, non erano più deboli di quelle che aveva contro X-Y-Z: erano esattamente le stesse prove. Questo è ciò che le ho scritto il 9 aprile scorso in una e-mail rimasta senza risposta. Ma la mia critica su quest'approccio selettivo nelle indagini ha portato ad una fine repentina dei nostri scambi.

E' ovvio che Maria Bamieh era perfettamente legittimata ad ignorare le mie critiche. Ma aveva perlomeno il dovere di richiedere le informazioni e i documenti che erano in mio possesso sugli altri quattro casi di cui si stava occupando: informazioni e documenti che le avevo scritto di avere e di cui lei – con le sue stesse parole - “aveva bisogno il prima possibile” perché il tempo stava per scadere.

Quindi due serie di domande possono essere poste. Ad EULEX: 1) Perché un’indagine preliminare sui cinque casi è stata aperta solo qualche anno dopo i fatti? 2) Perché le mie relazioni su due di questi casi sono state ignorate nel 2010-2011 e resuscitate nel 2014?

A Maria Bamieh: 1) Perché riteneva che il tempo stesse scadendo? 2) Perché ha scelto di non indagare i personaggi chiave del caso AUK: è stata una sua scelta, o stava agendo dietro consiglio o istruzioni dei suoi superiori? 3) Perché non ha cercato di ottenere le informazioni e i documenti che le avevo comunicato di avere sugli altri casi? e 4) Cosa è stato più svantaggioso per il corso delle sue indagini: l’assenza delle informazioni e documenti che le ho offerto e che non ha voluto avere o il presunto ostruzionismo dei suoi superiori?

EULEX è probabilmente titolata a non rispondere alle due domande, poiché presumo che siano state avviate indagini formali e che siano ancora pendenti. Ma Maria Bamieh non è più parte della missione ed ha scelto di parlare: per cui io sostengo che ha l’obbligo morale di rispondere a queste quattro domande.

In particolare, Maria Bamieh ha sostenuto che il suo supervisore, Jonathan Ratel, ha ostacolato le sue indagini sul caso della vendita di terreni pubblici in cui era coinvolto il signor Syla: è stato lui ad impedirle di chiedere a me le informazioni che le avevo offerto sul caso? Allo stesso modo, in un’intervista a Koha Ditore, la Bamieh ha sostenuto che quando è stata sospesa dal suo incarico - ovvero, una dozzina di giorni fa - stava ancora lavorando sul caso AUK: che cosa ha fatto tra il 9 aprile, quando aveva redatto la sentenza che apriva le indagini e il periodo successivo? Chi era oggetto di quelle indagini: X-Y-Z, o anche i sospettati più importanti? Senza risposte plausibili a queste a alle altre domande che ho formulato sopra, un’ombra rimane sui motivi che hanno spinto Maria Bamieh a parlare e, dunque, sulla correttezza e la plausibilità delle sue accuse.

L’assenza di risultati da parte di EULEX è dovuta - come sostengo nel mio prossimo libro e in un paper sulla performance di EULEX (entrambi discussi in un commento pubblicato sul Guardian oggi) - a negligenza, incompetenza e una generale inclinazione a non disturbare l’élite politico-economica del Kosovo, che in parte coincide con l’élite criminale del paese. Questi problemi, a loro volta, sono legati alla debolezza della trasparenza interna e della supervisione esterna, e dall’insufficiente garanzia dell’indipendenza dei giudici e dei pubblici ministeri della missione.

Poiché la corruzione giudiziaria è tipicamente correlata a questi fenomeni, in astratto le accuse di Maria Bamieh sono plausibili. Tuttavia, il caso su cui lei si è concentrata in particolare - l’accusa della tangente di 300.000 euro pagata all'ex giudice EULEX Francesco Florit - non sembra convincente, in primo luogo perché due di quelli nell'interese dei quali la tangente era stata presumibilmente intascata erano stati chiamati a scontare una pena a 25 anni per omicidio dalla corte presieduta dal giudice Florit (devo ammettere che conosco personalmente il giudice Florit: si veda il post-scriptum).

E’ inoltre plausibile che, come sostenuto da Maria Bamieh, i funzionari senior di EULEX abbiano cercato di minimizzare i suoi rapporti su questi casi, senza dubbio sconvenienti per loro. Ma se, come sembra possibile, le relazioni della Bamieh non erano credibili, sarebbe stato saggio da parte dei funzionari EULEX essere cauti nella gestione di quelle informazioni. Per cui, se la Bamieh non fornisce risposte plausibili a queste domande, è imprudente dare credito alle accuse che fa contro i suoi superiori per non aver preso per vere le informazioni che lei ha rivelato loro.

E’ molto plausibile che, come sostenuto dalla stessa Bamieh, i capi di EULEX abbiano cercato di ostacolare e ridimensionare le indagini che colpivano membri di primo piano dell’élite kosovara, indagini che avrebbero turbato la stabilità politica del paese: inclusa l’indagine della Bamieh. Ma i casi su cui lei si concentra - il caso AUK e il caso della vendita di terreni pubblici che ha coinvolto il signor Syla, sembrano piuttosto suggerire un’auto-censura da parte del pubblico ministero (cioè la signora Bamieh), che ha rinunciato a raccogliere informazioni potenzialmente cruciali che erano invece a sua disposizione. Paradossalmente, infatti, il comportamento della signora Bamieh nel caso di cui non ha parlato, ovvero il caso AUK, è un ottimo esempio dei problemi che lei denuncia. Esattamente come altri suoi colleghi e superiori hanno fatto in altri casi - descritti nei paragrafi 2.1, 2.2, 2.4-2.6, 2.9, 2.10 e 2.15-2.17 del mio paper su EULEX - nel caso AUK (discusso nel paragrafo 2.3) lei ha indagato solo personaggi minori coinvolti, e ha scelto deliberatamente (nel periodo aprile-marzo) di non indagare i casi maggiori nonostante la presenza di prove credibili contro di essi. Questo, per esempio, è precisamente quello che il signor Ratel ha fatto in un troncone dell’indagine sull'infame caso sul traffico di organi (discusso qui e nei paragrafi 2.16 del paper su EULEX).

In breve, qualunque sia il merito delle accuse di Maria Bamieh, esse sembrano troppo selettive per essere realmente pregnanti per un’analisi della performance di EULEX. La Bamieh è stata in missione per sei anni; ha gestito casi di corruzione e criminalità finanziaria, che tipicamente coinvolgono personaggi di alto-profilo; e adesso sostiene, testualmente che la missione “collabora con la mafia e i politici del Kosovo”: se fosse così, sono solo i pochi presunti episodi di corruzione e ostruzionismo rivelati dalla Bamieh gli unici degni di essere rivelati? Le sue rivelazioni sono inoltre passibili di generare confusione, perché distraggono l’attenzione dalle scelte di EULEX e dalla sua performance complessiva, che sono di dominio pubblico e formano una base sufficiente per articolare sia una critica del suo operato insoddisfacente sia un’interpretazione delle cause principali di questo fallimento.

Per questa ragione, indagare i casi che la signora Bamieh ha denunciato è una risposta insufficiente. Nel 2012 la Corte dei conti europea ha valutato la performance di EULEX nelle sue funzioni consultive, e ha pubblicato un rapporto credibile e piuttosto critico. Le funzioni giudiziarie erano però escluse dal mandato dei valutatori. Questo segmento di attività di EULEX non doveva essere vagliato con attenzione, perché è proprio lì che risiedono i peggiori fallimenti di EULEX ed è lì che la sua debolezza si manifesta nel modo più chiaro e dannoso.

Post scriptum. Conosco personalmente il giudice italiano accusato dalla Bamieh, il signor Florit. Tuttavia, non ho ragioni personali per difenderlo poiché ha commentato (privatamente) la mia critica (pubblica) ad un altro giudice italiano di EULEX, il signor Gianfranco Gallo, definendola come diffamazione irresponsabile (Gallo ha mosso una denuncia penale contro di me e il Tribunale di Milano ha sancito che le mie accuse contro il giudice Gallo - per quanto dure - erano legittime, ed ha respinto il ricorso). Questo mi consente di dire che, per quel che conosco del giudice Florit, sarei sorpreso del fatto che il giudice abbia accettato una tangente (se non altro perché gli manca completamente il senso dell’humour necessario ad intascare una tangente e poi spedire in prigione a 25 anni le persone che avrebbero dovuto essere protette da quello scambio di denaro).

Lo scopo della missione europea, lanciata nel 2008, era quello di aiutare le autorità kosovare a lottare contro la corruzione e instaurare nel Paese lo stato di diritto. Ora è proprio Eulex Kosovo a trovarsi al centro di pesanti accuse di corruzione. Prima si sussurrava di ‘lottizzazione’ tra Stati e competizione per ruoli di comando. Ora direttamente di soldi, oltre ai molti che già percepiscono regolarmente. A fare scoppiare il caso il procuratore britannico Maria Bamieh, ora sospesa dal suo incarico. La cosa singolare, legate forse a ben strane procedure, è che gli accusati restano al lavoro.

 

Le accuse sono gravi: Bamieh ha raccontato al quotidiano locale Koha Ditore di avere raccolto elementi secondo cui i responsabili di Eulex si sarebbero fatti comprare per chiudere almeno tre inchieste penali riguardanti casi di omicidio e corruzione. La denuncia riguarda in particolare il procuratore capo della missione, la ceca Jaroslava Novotna, il giudice italiano, Francesco Florit e il procuratore canadese, Jonathan Ratel. Bamieh sostiene di avere informazioni secondo cui l’Unione europea “spreca soldi dei contribuenti e non fa nulla per il popolo kosovaro”. L’acqua calda brucia.

 

Secondo l’agguerrita Maria Bamieh, ad esempio, il magistrato di Udine Francesco Florit avrebbe intascato una tangente di 300mila euro per annullare un’accusa di omicidio. Ovviamente tutto da dimostrare. Come la ‘conversione’ di Florit che dopo aver imparato l’albanese avrebbe osservato il digiuno del ramadan. Quasi banale l’accusa al capo della procura speciale di Eulex, Jonathan Ratel, di un trattamento di favore al parlamentare kosovaro Azem Syla. Caso ancora più drammatico, il favore al gruppo di Drenica’ dell’UCK per crimini contro civili i serbi ed albanesi nel 1998-1999.

 

Per capire: sino ad oggi la massima sanzione per crimini di guerra inflitta da un giudice kosovaro è stata la sospensione dal lavoro per tre anni al leader del gruppo, Sami Ljustaku, che frequentava amicali funzionari Eulex. Altri membri del gruppo potevano lasciare le celle per notti brave nei ristoranti di Pristina. Gli stessi frequentavano abitualmente alcuni alti rappresentati del governo kosovaro, tra i quali il ministro della Giustizia Hajredin Kuci, il ministro degli Esteri, Enver Hodzaj, e il procuratore di Pristina, Ismet Kabasijer. Un bel giro di galantuomini al disotto di ogni sospetto.

 

Storiaccia con memoria di cose d’altri tempi, scandali schivati e inchieste delicatissime ‘aggiustate’ quando a ‘proteggere’ il Kosovo nei liberato era ancora Unmick e la giustizia del dopo guerre era governata dagli americani. Da un americano. Ma c’erano anche alcuni bravi magistrati italiani e sbirri che forse hanno memoria, o altro. Ma non divennero mai Eulex. Per caso? Il presidente della commissione esteri, il tedesco Elmar Brok e il direttore per i Balcani, Fernando Gentilini, scoprono che ‘lo scandalo mette in gioco la credibilità della missione Eulex e dell’Ue in Kosovo’. Applausi.

 

Brucia ancora sull’Italia la storia dei tre jihadisti kosovari in giro per il mondo con un nostro visto. Uno si è fatto saltare in aria in Iraq, ma gli altri due sono a spasso. Lo scandalo all’ambasciata di Pristina in Kosovo, dove sono stati forniti centinaia di visti turistici ‘facilitati’. Coinvolti alcuni dipendenti locali e lo stesso ex ambasciatore, Louis Michael Giffoni, rimpatriato e congedato dal Ministero degli Esteri in fretta e furia. I visti erano venduti a 3.500 euro con l’aiuto di Uke Rugova, parlamentare e figlio del defunto presidente e padre dell’indipendenza del Kosovo, Ibrahim Rugova.

NACIONALISTIČKA PROVOKACIJA ALBANSKOG PREMIJERA

Nova komunistička partija Jugoslavije (NKPJ) najoštrije osuđuje nacionalističku provokaciju buržoaskog pro-imperijalističkog premijera Albanije Edija Rame, koji je drsko tokom posete Srbiji izjavio da je “nezavisnost Kosova neumitna i da mora biti poštovana”.

 

Znajući da uživa punu podršku zapadnog imperijalizma, kojem verno služi protivno interesima albanskog naroda, Rama je isprovocirao incident, sličan onome u čijem organizovanju je učestvovao njegov brat tokom odigravanja fudbalske utakmice Srbija – Albanija u Beogradu, kada je pušten dron sa zastavom fašističke tvorevine “Velike Albanije” iznad stadiona Partizana. NKPJ ističe da je nakon drske nacionalističke provokacije i mešanja Rame u unutrašnje stvari Srbije, dužnost republičke Vlade da mu otkaže gostoprimstvo i prekine njegovu posetu našoj zemlji.

NKPJ koristi i ovu priliku da izrazi žestok protest protiv pogubne politike buržoaske pro-imperijalističke Vlade Srbije na čelu sa Aleksandrom Vućićem koja vodi ka formalnom priznavanju “nezavisnosti” Kosova i ulasku Srbije u tamnicu naroda Evropsku uniju čiji je jedini cilj da bogati budu još bogatiji a siromašni još siromašniji. Zahtevamo da se odmah prekinu svi pregovori i kontakti sa marionetskim pro-imperijalističkim režimom u Prištini a da okupatorske trupe NATO, udarne pesnice zapadnog imperijalizma odmah napuste teritoriju južne srpske pokrajine Kosova i Metohije. NKPJ ističe da albanski i srpski narod na Kosovu neće moći da žive u miru i prosperitetu dok okupatorske trupe ne napuste teritoriju te pokrajine i dok se ona ne vrati u sastav matice Srbije. Za sve zločine i razaranja na Kosovu i Metohiji isključivi krivac je zapadni imperijalizam i njegove marionetske sluge u Prištini. NKPJ naglašava da Srbija i Albanija treba da žive u dobrosusedskim odnosima bez mešanja u unutrašnje poslove druge države. Građani Srbije i Albanije ne smeju da dozvole da ih svađa i uništava zapadni imperijalizam zarad svojih pljačkaških interesa. Radni narod u obe zemlje ima isti cilj a to je borba protiv buržoaske eksploatacije i isterivanje NATO imperijalista sa Balkana.

La visite historique du Premier ministre albanais en Serbie a tourné au vinaigre. Lors de la conférence de presse commune, Edi Rama a souligné que le Kosovo était indépendant, déclenchant l’ire de son hôte, Aleksandar Vučić. Demain, M. Rama se rendra dans la Vallée de Preševo, qu’il a qualifié de « pont entre la Serbie et l’Albanie ».

Les Premiers ministres serbe Aleksandar Vučić et albanais Edi Rama ont laissé éclater lundi devant les caméras leurs divergences sur le Kosovo.

« Je ne permettrai à personne d’humilier la Serbie à Belgrade. Le Kosovo-et-Métochie n’a rien à voir et n’aura jamais rien à voir avec l’Albanie », s’est offusqué Aleksandar Vučić. « Le Kosovo est serbe, comme l’indique la Constitution de notre pays. C’est la dure réalité et je suis heureux d’être en mesure de le répéter devant M. Rama. »

Contenant difficielement sa colère, Aleksandar Vučić s’est dit « désolé » que son homologue albanais ait mentionné le Kosovo lors d’une conférence de presse conjointe au Palais de Serbie, peu après leur rencontre en tête-à-tête, soulignant que le sujet ne figurait pas à l’agenda officiel des discussions. Il a cependant ajouté qu’il espérait que les entretiens avec le Premier ministre albanais allaient se poursuivre.

Auparavant, Edi Rama avait rappelé que Preševo était un « pont d’importance stratégique entre deux pays partageant le même destin européen ».

« Concernant le Kosovo, nous avons des opinions divergentes », a déclaré le Premier ministre albanais. « Mais la réalité est irréversible et doit être respectée. La reconnaissance du Kosovo par les États européens est d’une importance capitale. »

« L’indépendance du Kosovo a fait que les Balkans sont plus stables et pacifiques », a encore estimé le chef du gouvernement albanais.

La plus grande partie du discours d’Edi Rama a été retransmise en direct sur la  RTS... sans être traduite de l’albanais. « Une erreur technique », s’est justifiée la chaîne nationale serbe.

Par ailleurs, le protocole dans les cérémonies a manifestement été « allégé », les drapeaux albanais étant bien peu visibles dans les rues de Belgrade ce lundi.

Nouveau départ ?

Plus tôt dans la journée, les deux Premiers ministres ont convenu d’élaborer un accord permettant aux citoyens d’Albanie et de Serbie de franchir les frontières simplement munis de leur carte d’identité. Quant aux projets d’infrastructure importants, « nous voulons d’abord adhérer à l’Union européenne avant d’aller plus loin », a déclaré Aleksandar Vučić .

L’entretien entre les deux hommes a davantage porté sur la coopération économique et les échanges commerciaux entre les deux pays. Les gouvernements d’Albanie et de Serbie ont également signé un accord sur l’assistance mutuelle en matière de prévention et de répression des infractions douanières.

Mardi, Edi Rama doit se rendre dans la Vallée de Preševo. Ce sera la première fois qu’un Premier ministre albanais se rend à titre officiel dans cette région à majorité albanaise négligée par les autorités de Belgrade. « Une visite historique », s’est félicité le maire de Preševo Mustafa Fahmi.

Trafic d’organes au Kosovo : les principaux suspects échappent toujours à Eulex

Cela fait maintenant deux ans et demi que les deux principaux suspects ont été mis en examen dans l’affaire de trafic d’organes à la clinique Medicus. Pourtant activement recherchés, fichés par Interpol, le médecin turc Yusuf Sönmez et l’Israélien Moshe Harel sont toujours introuvables. La justice d’Eulex s’impatiente.

 

(Avec Balkan Insight) - Plus de huit mois après les premières condamnations dans l’affaire de trafic d’organes à la clinique Medicus, la mission Eulex a reconnu qu’elle ne disposait toujours pas d’informations lui permettant d’arrêter les deux principaux suspects.

Le médecin turc Yusuf Sönmez et l’Israélien Moshe Harel, accusés de trafic d’organes et de crime organisés sont en cavale depuis qu’ils ont officiellement été inculpés en juin 2011. Ils figurent pourtant sur les fichiers des criminels activement recherchés d’Interpol.

Le juge d’Eulex Malcolm Simmons s’est dit « inquiet que rien ou presque n’ait eu lieu depuis ». « Nous ne pouvons faire que le strict minimum tant que les accusés n’ont pas été arrêtés », a-t-il rappelé lors d’une audience qui s’est tenue à Pristina pour rendre compte de l’évolution de l’enquête sur le trafic d’organes.

Pour le procureur d’Eulex Allen Cansick, « Harel se trouve toujours en Israël », tandis que « la mission a des informations qui indiquent que Sönmez se déplace tout autour de la planète ». Le procureur se veut néanmoins optimiste : « il y a des chances qu’ils soient un jour conduits au Kosovo ».

Les accusés ne peuvent pas être jugés par contumace, de sorte qu’un éventuel futur procès dépend de leur extradition.

Il leader dell’Alleanza per il futuro del Kosovo, l’ex comandante della terroristica UCK Ramus Haradinaj, il quale è accusato dal tribunale dell’Aja di crimini di guerra, è tornato in Kosovo. I giudici hanno permesso che egli fosse rilasciato in libertà temporanea. La portavoce dell’Eulex Irina Gudeljevic ha dichiarato che la missione dell’Unione europea parteciperà al controllo delle condizioni che Haradinaj deve rispettate mentre si trova in libertà temporanea. Su richiesta di Haradinaj il consiglio dei giudici ha deciso che egli sarà libero fino all’emissione della sentenza nel nuovo processo contro di lui. Insieme con Idriz Baljaj e Ljahi Brahimi Haradinaj è accusato di crimini di guerra che sono stati commessi in Kosovo nell’anno 1998. I discorsi finali nel loro processo dovrebbero essere tenuti il 25 e il 26 giugno. Nel processo di prima istanza Haradinaj e Baljaj sono stati esonerati da ogni accusa, mentre Brahimi è stato condannato a sei anni di detenzione. Dopo il ricorso della procura il consiglio d’appello ha imposto che il processo fosse rinnovato in sei dei 37 capi d’accusa. La procura ha valutato che durante il processo esistevano molte difficoltà nella raccolta delle deposizioni dei testimoni. Molti di loro hanno detto che a causa della paura non sarebbero apparsi davanti ai giudici.

UNSC debates organ trade draft

NEW YORK: Consultations are ongoing in the UNSC on Serbia's resolution on human organ trafficking in Kosovo, the Serbian Mission to the UN told Tanjug on Friday.
Russia is presiding over the UN Security Council until the end of December and intensive consultations have taken place in recent days on the text of the resolution, which calls for the appointment of a special representative of the UN Secretary-General Ban Ki-moon to oversee the investigation, but UNSC member countries have yet to reach a compromise.
No agreement has been reached and the UNSC is not expected to meet before the New Year, but consultations are ongoing, Tanjug has learned from the Serbian Mission to the UN. But the UNSC will suspend its activities for the year on Friday, barring emergencies. 
Western countries in the UNSC believe only EULEX should be in charge of an investigation into the allegations made in Council of Europe Rapporteur Dick Marty's report. Belgrade, on the other hand, is advocating an independent investigation under a UN mandate, as the crimes mentioned in the report are not contained to Kosovo alone.

West refuses to probe organ trafficking – Russian envoy

MOSCOW: Russian Ambassador to UN Vitaly Churkin says he does not understand why the West refuses to carry out an investigation into human organ trafficking in Kosovo.
“We are very upset over this fact. We do not understand why our western colleagues in the UN refuse to implement measures which would confirm legitimacy of the EULEX investigation in Kosovo and find perpetrators of these crimes,” he told Russia Today.
The Russian envoy stressed that the Serbian delegation in the UN in cooperation with Russian diplomats had drafted a relatively simple resolution which envisaged appointment of a special representative of the UN secretary general in charge of control of the EULEX mission and protection of witnesses. 
“I believe that EULEX mechanism is insufficient for implementation of an appropriate investigation, protection of witnesses and reporting to the UN Security Council. I fear that after five or six years of confidential investigations they will announce that they were not able to discover anything
, that witnesses are deceased or murdered in the meantime, and that everything is over,” Churkin explained. 
He underlined that Russia did not want silence to wrap this monstrous crime, but that for some reason that were unknown to him, there was a certain resistance in his western colleagues regarding a full investigation into the crime contained in the report by Council of Europe Special Rapporteur Dick Marty. 
“Nevertheless I think that we will continue to work in this direction in 2012 as well, and that this resolution will be accepted so that the crime would not be forgotten,” Churkin concluded. 
Members and leaders of the ethnic Albanian KLA are suspected to be the perpetrators of the atrocities, targetting kidnapped Serb and other civilians in Kosovo in 1999 and 2000.

KLA DETENTION CAMPS

In my late December essay in 2010  called Amorality of US Kosovo Policy: Friends with the Snake I have published reactions to the Council of Europe (CoE) 27-page report authored by the Swiss-Italian politician, senator and prosecuting lawyer Dick Marty. The report, after his two-year investigation, claimed that the Kosovo Liberation Army (KLA) thugs headed by the current Kosovo prime minister Hashim Thaci, known as the “Snake,” abducted mostly Kosovo Serbs but also some Albanian so called “collaborators,” transported them to northern Albania, murdered them, extracted their organs like the kidneys, and sold them on the black market. These macabre Nazi/Croatian Nazi style crimes were covered up by the leading international organizations such as the UN, NATO, OSCE as well as the governments of leading western countries. NATO’s secret documents as well as an UN report have been leaked out clearly demonstrating that both of those international organizations had full knowledge of these grisly crimes and opted to cover them up in addition to several western governments, the U.S. and Germany in particular. While a EULEX investigation is being launched, it will focus on the grisly crimes committed by the Snake and his thugs but will not include an investigation of those who enabled these crimes to be covered up for over a decade. In addition, it is doubtful if EULEX is capable of conducting an all-encompassing inquiry. Hence, the most important question needs to be posed: Is the justice going to be served.

 

CoE Session: 169:8 Votes

On January 25, the CoE supported Dick Marty’s resolution demanding investigation into organ harvesting macabre crimes with a vote of 169:8. The resolution calls for EULEX to continue its investigation. It also calls for the governments of Serbia, Albania and Kosovo institutions to fully cooperate. Amendments proposed by the Albanian deputies were overwhelmingly rejected, while two amendments proposed by Marti were accepted. His first amendment seeks clarification dealing with EULEX competencies, or some other judicial body with mandate to conduct investigations, with regard to territorial and timeline aspects of all crimes committed in Kosovo. The second amendment specifies what is expected from the Albanian authorities and the Kosovo institutions. On his part Marty committed to submit all the evidence he accumulated providing the witness protection is guaranteed. He indicated that he found credible witness, who have nothing to do with Serbia, but who are afraid of the Kosovo judiciary, and added that the witness protection is scandalous.

Serbian president Tadic addressed the CoE session demanded an investigation and pointed out that there is no institution with a mandate to carry out an investigation of this kind and that such an institution should be immediately created. Sweeping the gruesome crimes under the carpet is not an option.

Dick Marty felt that EULEX is powerless to investigate these grisly crimes. “An ad-hoc judicial structure needs to be created—established specially to investigate the organ trafficking and located outside of Kosovo, which would have the right to apply measures to protect witnesses and their families—just during the process but afterwards as well. The witnesses have so much to say that their lives would not be worth much afterwards if their identities were revealed.” On March 10, Marty is scheduled to appear before the European Parliament (EP) Foreign Affairs Committee.

 

Human Rights Watch

Human Rights Watch (HRW) and the Amnesty International (AI) are the only two western-oriented international human rights organizations operating worldwide. They play the complementary roles with the HRW main products being crisis-directed research and lengthy reports. Their European director Benjamin Ward gave an interview to Radio Free Europe. In it they advocated for the EU to appoint a highly specialized prosecutor with the investigation taking place outside the Balkans in order to protect the witnesses. The HRW doesn’t believe that EULEX is capable of conducting a proper investigation given their track record including the fact that the organ harvesting was known for a long time. Hence, the HRW and Dick Marty are in full agreement that EULEX is not the organization to conduct an investigation

 

EU

Despite these warnings from Marty and the HRW, the EU has asked the EULEX to conduct the investigation, has asked Marty to provide his evidence and is negotiating ways to protect the witnesses. EULEX has about 20 investigators and 40 judges and the EU is ready to send more. The EULEX prosecutors have already initiated a preliminary investigation and can start immediately if they receive the evidence collected by Marty.

 

NATO’s Secret Documents

The CoE report is further supported by NATO’s secret documents tagged “USA-KFOR,” which were leaked to the British The Guardian and published the day the CoE debated the Marti report. According to the papers, the Snake has been identified as one of the “biggest fish” of organized crime in Kosovo. He was the head of a “mafia-like” network responsible for smuggling weapons, drugs and human organs during and after the 1998-99 Kosovo war. Xhavit Halili, member of the Drenica gang, former KLA logistics head and a high level official in Thaci’s party is identified for the same crimes as Thaci. Halili, described as “the power behind Hashim Thaci,” and Thaci’s chief “political and financial adviser,” carries a Czech 9mm pistol. He is also implicated in two murders in Albania including that of the young Tirana journalist Ali Uke, who shared an apartment with Thaci.

It has become more than obvious that that the 2008 irresponsible push to recognize Kosovo’s independence came against a background of full awareness of  Snake’s and his thugs criminal track records. Nonetheless, the western powers preferred to turn a blind eye to Kosovo reality and what was originating from Kosovo.

 

UN 2003 Investigation

In this era of WikiLeaks the UN report dated October 30, 2003 was leaked.  France 24 TV channel was one of several media outlets to reveal the content of this confidential report. Even this author managed to get a copy of this 29 page report. The report originated from Eamonn Smyth, Head of ICTY Mission in Skopje and Pristina to Patrick Lopez Terres, Chief of the ICTY Investigations. The report says that 100-300 mostly Serbian men were abducted and taken by truck/van to detention facilities in Albanian towns of Kukes and Tropoje. Beginning in August 1999 some of these captives (24-100) was transferred from Northern Albania to secondary detention facilities (private homes and rough industrial compounds) in central Albania, mainly near the towns of Burrel and Peshkopi. Then they were moved to a private house south of Burrel that was setup as a makeshift clinic. There, medical equipment and personnel were used to extract body organs from the abductees, who then died. Their remains were buried nearby. The organs were transported to Rinas airport near Tirana. It should be noted that the airport was under the NATO control. A small number of female captives from Kosovo, Albania and Eastern Europe were also taken to the clinic. In addition to abductees taken to Albania alive, an unknown number of bodies of Serbian civilians killed in Kosovo were transported to Albania and buried in remote locations. The last delivery of captives was reported in spring or early summer 2000.

The report identifies at least eight sources, all ethnic Albanians from Kosovo and Montenegro who served in the KLA. In the report they were listed with numbers as their identities were withheld. Four, who have directly participated in the transport of at least 90 Serbs, provided very detailed accounts of their roles including the exact dates. Of these, three sources delivered captives to the house/clinic south of Burrel. Two have participated in the disposal of human remains and one who has participated in the delivery of body parts to Rinas airport. The transports and surgical procedures were carried out with the knowledge and/or active involvement of mid-level and senior KLA officers. Doctors from Kosovo as well as an Arab doctor were involved. The operation was supported by the men with links to the Albanian secret police operatives of the government of Sali Berisha. Maps of the site locations were included. 10 Serbian victims were identified by name.

In an interview with France 24, Dick Marty claimed that he was unaware of the document but the events described were known to him. The French TV asserted that the UNMIK report was never forwarded to EULEX and reminded the viewers that while these grisly crimes were taking place tens of thousands of NATO soldiers, UNMIK and OSCE personnel were charged with responsibility to protect the civilians.  

 

UN Security Council Session

A Kosovo session of the UN Security Council (UNSC) took place on February 16. The UNMIK chief Lamberto Zanier submitted his quarterly report in which he described Kosovo as politically unstable and insecure. He requested that a Marty report all-encompassing investigation should be given due priority. In addition he expressed hope that the Kosovo government, now in the making, will consist of people with “clean hands.” The Serbian foreign minister Vuk Jeremic requested a UN inquiry. Jeremic described Marty’s report as “deeply disturbing” and suggested the EULEX investigation is not enough because the allegations involved locations outside Europe such as Asia and Africa. “The solution lies in establishing an ad hoc investigating mechanism created by—and accountable to—the Security Council.”

However, the U.S. envoy Rosemary Di Carlo asserted that the EULEX investigation was sufficient. “We do not believe that an ad hoc UN mechanism is necessary or appropriate,” She was supported by the UK and German representatives, while Jeremic received support from Russia, China, South Africa and Gabon. The U.S. seems to be against an ad-hoc court in order to avoid an equalization of the Kosovo Albanian crimes with those committed by the Serbs and dealt with by the ICTY.  

 

Impact in Kosovo

The Marty report has degraded Thaci’s credibility as well as Kosovo’s international reputation. Thaci has never been so weak politically. He has been weakened also by his row with Fatmir Limaj, the outgoing minister of transport. Timing of leaked NATO and UN documents could be interpreted as an attempt by Thaci’s former sponsors to tell him that his time is up and that he should withdraw from the political scene. Thaci was experiencing difficulty forming a new coalition government after the December 12 elections marred with irregularities. His party won 34 seats in the new 120-member parliament. Other big parties, the Democratic League of Kosovo (LDK) with 27 seats and the Self-Determination with 14, indicated that they want Thaci out of any future coalition government even if his party (DPK) stays. Hence, Thaci had to rely on small parties to secure the majority. At the same time some western ambassadors suggested that the new government should not include those subjected to the criminal probe. Thaci has been forced to drop his loyalist Jakup Krasniqi, the acting Kosovo president who empowered him with a mandate to form a new government, in favor of Behgjet Isa Pacolli, the world’s richest Albanian who made his fortune in Switzerland. In exchange Pacolli’s party, the New Kosovo Alliance (AKR), will enter into Thaci’s coalition. Thaci has also offered a position of the Kosovo government VP (one out of four) to the leader of the Serbian Independent Liberal Party Slobodan Petrovic including the three ministries (the same as the AKR). In addition, other minorities—the Turks, Ashkali, Egyptians—will be represented in Thaci’s government with two ministries. Hence, it appears that Thaci has been successful in forming the new government. It remains to be seen if Pacolli will get enough votes for the presidency.

 

Who is Pacolli?

The world richest Albanian, second of a family of 10 children, left Kosovo penniless for Germany at the age of 17. After the military service, he joined an Austrian company, but two years later moved to Switzerland joining a Swiss company he got to know in Moscow. In 1990 he founded Mabetex Project Management, a construction company based in Lugano. This company evolved into a large business group called the Mabetex Group, which handled many international construction jobs in Russia, Kazakhstan, Italy and Uzbekistan. Pacolli remains the President and CEO.

Offices of Mabetex Group were searched in 1999 at Russia’s request and he was questioned by then Swiss State Prosecutor, Carla Del Ponte. The Swiss authorities charged him in June 2000 with money laundering and providing bribes worth $4 million. The proceedings in Russia were closed in December 2000 and in Switzerland in March 2002.  It was a corruption scandal close to then Russian President Yeltsin and several officials suspected of accepting bribes in exchange for the Kremlin reconstruction job.

Pacolli has been actively lobbying for Kosovo’s independence since 2004/2005. In 2006 he founded the New Kosovo Alliance (AKR); in 2007 his party came third in the parliamentary elections.  It has been reported by the Finnish media that former Finnish President Martti Ahtisaari, who was appointed by the UN as special envoy for Kosovo, was bribed by the Albanian mafia (some speculated that Pacolli was involved). Ahtisaari delivered the Kosovo Independence recommendation and was even awarded the Nobel Peace Price for 2008. When Carla Del Ponte published her book, Pacolli initiated a legal procedure against her book—requesting a ban on the book being sold and distributed.

Since Kosovo’s unilateral declaration of independence, Pacolli has been lobbying many countries to recognize Kosovo. The Maldives Parliament launched an investigation on the basis of suspicion that its government officials were involved in taking bribe of $2 million for the recognition of Kosovo. According to the Maldivian media, the government officials received the bribe from Pacolli. The Maldives became the 55th of the 192 members to recognize Kosovo.

Pacolli might be an angel in comparison to Thaci. However, he is obviously not reluctant to use his wealth to bribe officials in order to advance his and Albanian causes. As such he is likely to be acceptable in the West, but unlikely in Moscow. Despite his Russian wife, he has lobbied for the Nabucco gas pipeline and Iran-Turkey-Greece-Albania-Kosovo pipeline which is contrary to the Russian interests in the Balkans.

 

Berisha in Trouble Again

In addition to Thaci’s problems in Kosovo, the Berisha regime in Albania is in trouble again. Mass demonstrations broke in Tirana after it was revealed that Berisha’s Deputy Prime Minister “in secretly taped talks, openly negotiating the level of bribes to back the construction of a new hydroelectric power station.” Police reacted with violence killing three people with some 150 injured. The opposition, Socialists party, is demanding early elections over corruption and vote rigging in 2009 general election. Berisha’s services for supporting the Washington agenda in the Balkans were awarded with Albania’s membership in NATO. The Albanian opposition continues to hold anti-government protests ignoring the international pressure for a compromise.

It should be recalled that the BBC reported on March 23, 1992 that Berisha, who then became the president of Albania, said: “There is no Albania without Kosovo and vice versa.” He was re-elected in 1997 but had to resign because of the collapse of a fraudulent Ponzi type of scheme, which led to anarchy and killings necessitating the Italian troops to intervene with the UN approval.  He has openly supported the Kosovo Albanian drive for independence with the ultimate aim to create a Greater Albania. His rule also led to freedom of movement for mafia operations. He gave his family farm to the KLA for military training purposes thus enabling the KLA to wage a war of insurrection into Kosovo. He maintained close links with Thaci and must have known about the organ harvesting scandal and may have even actively participated in it. Most of the KLA crimes took place in Albania, but Berisha has refused to cooperate in the prior investigations.

Albania has long been known as a hot spot in the illicit trade of human organs. A 2004 report written by the Greek Embassy in Tirana detailed the illegal Albanian organ trading operating since 1994. The report says that children were snatched from their families in various parts of Albania, or sold, in many cases for the price of a TV set. The victims were taken to clinics in Albania or to a clinic in Yiannitsa in Central Greece, while their organs were smuggled out of Albania and Greece and sold in Italy and France.

 

Switzerland

The Swiss media has been reporting on the KLA activities in Switzerland. Geneva’s Le Temp revealed that the Snake lived in Switzerland 1994-1998. He had a political asylum status but travelled to Kosovo 5-6 times per year in violation of the Swiss law. The paper identified five other KLA members who were collecting the contributions from the Albanian diaspora and money laundering.

A Zurich paper focused on Haliti and his symbiotic relationship with Thaci in an article titled “The most dangerous Kosovo man with Swiss past.” Haliti came to Switzerland in 1986 and was linked with money laundering and trading with weapons, drugs and women. He was in business with a company controlled by jihadists.

The media predicts that the foreign affairs committees will address the Swiss Kosovo policies. The Swiss parliament adopted the resolution calling for a neutral international court to investigate corruption in Kosovo as well as the EULEX.

 

EULEX Investigation to follow ICTY footsteps?

Arguments have been made, by both  Marty and the HRW, as well as the Serbian foreign minister Jeremic, why EULEX cannot deliver justice. Nonetheless, the U.S./EU have opted for EULEX. What is left is for the UNSC is to attempt to find a way to constraint the U.S./EU from writing rules aimed at justifying flawed U.S./NATO Balkan policies rather than serving justice. In other words the experience of a political court of dubious legality such as the International Criminal Tribunal for Former Yugoslavia (ICTY) should not be allowed to be replicated. ICTY destroyed the evidence collected in 2003. Four critical books have been written on the subject of the ICTY: Diana Johnstone’s Fools Crusade (2002); Michael Mandel’s How America Gets Away with Murder (2004); Peter Brock’s Media Cleansing (2005); and John Laughland’s Travesty: The Trial of Slobodan Milosevic and the Corruption of Justice (2007). Laughland focuses on “The Corruption of International Justice.” He stresses that the ICTY is a political court with explicit political objectives that run counter to the requirements of justice.

 

Should UN/NATO be investigated?

As discussed above both the UN and NATO were fully aware of the role the Snake and his thugs had played in these macabre crimes but chose to cover it up. Therefore a true investigation should include those organizations as well. However, it is extremely unlikely that this would take place as these organizations enjoy the status of impunity. Michael Mandel, professor of law at Osgoode Hall Law School in Toronto, in 1999 led an international effort to have NATO prosecuted for crimes against humanity committed during the Kosovo war. While meticulously documented his case didn’t get anywhere.

On the other hand, it should be of interest to at least to two countries, i.e. the U.S. and Germany, which played a pivotal part in selecting the KLA and its leaders with known criminal records as partners in order to amputate Serbia. In England, a parliamentary committee is investigating why Great Britain went to war in Iraq. Tony Blair testified twice before the committee. There will be no indictments but the British public will find out why their prime minister opted for the war ignoring the will of the public. A similar type of investigation should be at least conducted by the U.S. Congress with a broad objective of establishing how the U.S. ended up with the war in Kosovo… As a part of that type of an investigation issues such as partnership with Hashim Thaci and his thugs as opposed to supporting pacifist Ibrahim Rugova should be addressed. An important part of such an investigation would be macabre organ harvesting case with the associated cover-ups, which have further eroded the U.S. credibility in the world.

 

“The Culture of Impunity, NATO Style”

Diana Johnstone wrote a piece with the above quoted title. She expressed an opinion that “the Marty report appears fated to join the Goldstone Report on Gaza in the limbo of good intentions” and pointed out to the London Review of Books (LRB), which chose to publish a five-page review of the Marty Report by no other than Sir Geoffrey Nice. His rise to fame was prosecution of Slobodan Milosevic at the ICTY. He blamed Milosevic for all Former Yugoslavia ills and “succeeded in sending Milosevic to his grave before he could present his defense, thus sparing the three judges the task of finding excuses to convict him, as they were hired to do.” Dennis MacShane, a former Labor Minister for Europe, followed up with an attack dog type article published in the Independent and the Wall Street Journal. He was suspended from the Labor Party pending investigation into his expense account padding amounting to 125,000 pounds.

Nice compared Thaci with Djukanovic in Montenegro, who has decided to step down and cease to hold a political office in order to facilitate Montenegro’s entry into the EU. Djukanovic is famous for his grand-scale cigarette smuggling empire, which led to indictment in Italy. Johnstone read Nice’s comparison “as acknowledgement that both NATO protégés are crooks to some degree or other, who were useful in wresting their lands away from the Serbs, but now had best step back to make way for more presentable puppets. Being prosecuted for those wrongdoings, whatever they may be is, however, out of the question.”

Johnstone ends on the following note: “Human rights campaigners in the self-righteous Western democracies are intransigent when it comes to ending what they call ‘the culture of impunity’ so long as it involves, say, Africa. But their own impunity and that of their clients seems more secure than ever.”
